Digital Millennium Copyright Act — Infringement Reporting Procedures

1. Overview

Archimedes Market LLC ("Archimedes Market") respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. We respond promptly to notices of alleged copyright infringement that comply with the DMCA and other applicable intellectual property laws.

2. Designated Agent

3. Filing a DMCA Takedown Notice

If you believe that content on the Platform infringes your copyright, you may submit a written notification to our Designated Agent. Under 17 U.S.C. § 512(c)(3), your notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are involved, provide a representative list.
  3. Identification of the material claimed to be infringing, including information reasonably sufficient to locate the material on the Platform (e.g., URL of the asset listing).
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

4. Counter-Notification

If your content was removed due to a DMCA takedown notice and you believe the removal was the result of a mistake or misidentification, you may file a counter-notification. Under 17 U.S.C. § 512(g), your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where the material appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which Archimedes Market may be found), and that you will accept service of process from the person who provided the original takedown notice.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we will restore the removed content.

5. Repeat Infringer Policy

In accordance with the DMCA, Archimedes Market will terminate the accounts of users who are repeat infringers in appropriate circumstances. We define a repeat infringer as any user who has been the subject of three (3) or more valid DMCA takedown notices.

Upon the third valid notice:

  • The user's account will be permanently terminated
  • All of the user's content will be removed from the Platform
  • Pending payouts may be held or forfeited

6. Good Faith Notice Requirement

The DMCA provides for liability against any person who knowingly makes material misrepresentations in a takedown notice or counter-notification (17 U.S.C. § 512(f)). Filing false or fraudulent DMCA notices or counter-notices may result in legal liability and account termination.

7. Other IP Complaints

If you believe content on the Platform infringes your non-copyright intellectual property rights (e.g., trademark, trade secret, patent), please contact us at support@archimedes.market with a detailed description of the alleged infringement.
